General Terms and Conditions (GTC) of Opera Machines
1. Scope
These General Terms and Conditions (GTC) apply to all contracts between Opera Machines , owner Jürgen Grünbeck, Brauergasse 24, 93059 Regensburg (hereinafter “Opera Machines”) and our customers.
2. Subject matter of the contract
Opera Machines offers exclusive, limited-edition espresso machines and editions that are handcrafted and finished with select natural stones. Each machine is unique.
3. Conclusion of contract
The presentation of the products on the website does not constitute a legally binding offer, but rather a non-binding invitation to inquire. A contract is only concluded upon written confirmation by Opera Machines.
4. Prices and payment terms
All prices are in euros and include VAT. Payment is to be made exclusively in advance by bank transfer . Production or delivery of the machine will only begin after full payment has been received. In case of delay of payment of more than 14 days, Opera Machines reserves the right to withdraw from the contract.
5. Delivery and shipping
Delivery is exclusively via freight forwarding company. Delivery times within Europe are usually 4–6 weeks after receipt of payment. International shipping outside of Europe is generally possible, but only after individual consultation and separate agreement. Delivery costs are calculated separately and depend on the destination and size of the order. The customer is obliged to accept the delivery at the agreed time and to ensure suitable access (e.g. at ground level or with a lift).
6. Transfer of risk
Upon handover of the goods to the customer or a person authorized by the customer, the risk of loss or damage to the goods shall pass to the customer. 7. Custom-made products Opera Machines manufactures machines according to the customer's individual material selection. Due to the unique nature of the stones, minor variations in structure, grain, and color are unavoidable and do not constitute a defect.
8. Retention of title
The goods remain the property of Opera Machines until full payment has been made.
9. Warranty and Liability
The statutory warranty rights apply to our products. Any further liability, in particular for slight negligence, is excluded unless mandatory statutory provisions prevent this.
10. Right of withdrawal, exchange and return
Since Opera Machines are exclusively individually manufactured and limited unique pieces, a right of withdrawal according to Section 312g Paragraph 2 No. 1 BGB is excluded. Exchange or return of goods after conclusion of the contract are also excluded . Every order is binding for the customer.
11. Force majeure
Opera Machines is not liable for delivery delays or service failures caused by force majeure events (e.g., natural disasters, strikes, political events, transport disruptions, pandemics).
12. Protection of intellectual property
All designs, texts, images and other content of Opera Machines are subject to copyright and may not be used or reproduced without written consent.
13. Contract language and applicable law
The contract language is German. German law applies. Mandatory provisions of the country in which the customer has their habitual residence remain unaffected. The place of jurisdiction for all disputes is Regensburg, to the extent permitted by law.
14. Severability Clause
Should individual provisions of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
